1 | Acceptance of Terms
These Terms of Service (“Terms”) govern access to and use of the FamilyTalk mobile application and related services (the “App”), operated by Pacific Analytics, L.L.C.
By accessing or using the App, you agree to be bound by these Terms. If you do not agree, you may not use the App.
2 | Description of Service
FamilyTalk is a secure, artificial intelligence supported, moderated communication platform designed to facilitate communication between residents of rehabilitation or care facilities, approved family members, and authorized facility staff.
The App enables messaging and media sharing within a controlled, facility-managed environment.
3 | Eligibility and Account Access
Access is invitation-only and controlled by participating facilities.
Provide accurate account information;
Maintain account security;
Use the App only as authorized.
4 | User Conduct
Do not upload harmful, abusive, or unlawful content;
Do not violate rights of others;
Do not circumvent moderation systems;
Do not interfere with App security.
5 | A.I. Supported Moderation
FamilyTalk uses A.I. tools to identify potentially inappropriate content and support moderation. All final decisions involve human review and facility oversight.
6 | Content and User Data
You retain ownership of your content but grant FamilyTalk a limited license to process, store, and transmit it to operate the App and maintain safety.
7 | Facility Control and Responsibility
Participating facilities control access, permissions, and moderation. FamilyTalk is not responsible for facility decisions.
8 | No Medical or Clinical Relationship
FamilyTalk is a technology platform only and does not provide medical or clinical services.
9 | Data Security and HIPAA
FamilyTalk implements safeguards designed for use in environments subject to HIPAA where applicable. Facilities remain responsible for compliance.
10 | Third-Party Services
The App may rely on third-party providers for hosting, storage, and authentication.

The App incorporates moderated artificial intelligence (“A.I”) assisted tools to help identify potentially inappropriate or unsafe content, enabling timely moderation by authorized Facility staff in the effort to support a safer communication experience.
FamilyTalk is deployed in partnership with participating Facilities, which maintain control over user access, participation, and moderation. Each Facility operates within its own secure and individualized environment and users may only interact within their authorized community.
By facilitating consistent and monitored communication, FamilyTalk aims to strengthen relationships, promote overall emotional well-being, and support active engagement during the rehabilitation and recovery process.
FamilyTalk does not provide medical, clinical, diagnostic, or treatment services and the use of the App does not establish any healthcare provider-patient relationship with the Developer. A.I. supported features within the App are used to assist platform functionality and moderation, but do not independently make decisions affecting users without human review and intervention.
FamilyTalk is designed to support use in healthcare and rehabilitation environments and may be operated in a manner intended to support compliance with the Health Insurance Portability and Accountability Act of 1996 (“H.I.P.A.A.”), where applicable, including through Business Associate Agreements (“B.A.A.s”) with participating Facilities.
Access to Application:
Access to FamilyTalk is only granted through Facility issued invitations (via text message or email invite and separate authentication). Accounts are created only under Facility supervision and authorization, and each Facility retains discretion over who may join the community. The Facility also retains the discretion to revoke user access at any time.
Information and Data Practices:
FamilyTalk is specifically designed to minimize data collection and retention. The Developer does not use personal information for advertising, marketing, behavioral tracking, profiling, or data monetization, and does not sell personal information. The Developer only processes limited information necessary to operate the App.
Users provided the following information to support the following functionality of the App:
(1)Account identifiers (i.e. name, phone number, email, login credentials);
(2)Current App version;
(3)Messages and content (photos) uploaded by users;
(4)A.I. content flagged for moderation by Facility staff;
(5)A.I. suggested revisions for inappropriate or offensive user content;
(6)Authentication tokens;
(7) Device type and operating system; and
(8)App performance data (i.e. crash logs).
User information is used only for the following limited purposes within the App:
(1)Enable messaging and communication;
(2)Support A.I. assisted content moderation and safety tools;

Information Sharing:
The Developer does not sell personal information. Personal information may only be shared in limited circumstances:
(1)With the participating Facility that authorized the user;
(2) When required by State Law, Federal Law or Court Order; and
(3)To protect safety, rights, or to prevent harm.
Data Security and Health Insurance Portability and Accountability Act Compliance:
FamilyTalk implements administrative, technical, and physical safeguards designed expressly to protect user personal information and to comply with the H.I.P.A.A., where applicable.
The App, as part of Pacific Analytics, L.L.C., operates in a manner intended to meet all applicable H.I.P.A.A. requirements when providing services to participating Facilities that are contracted business associates.
Specific safeguards related to H.I.P.A.A. compliance include:
(1)Encryption of data in transit (HTTPS/TLS);
(2)Role based access controls;
(3)Secure invitation, login, and authentication systems;
(4)Facility level data segregation;
(5)Authenticated file access; and
(6)Audit logging of access and moderation activity.
FamilyTalk could process information on behalf of participating facilities that may constitute Protected Health Information (“P.H.I.”) depending on how the platform is used. When required, and as applicable, the Developer will enter into H.I.P.A.A. B.A.A.s with participating facilities governing the handling of P.H.I.

FamilyTalk is intended for use within the United States. All data is stored in United States based infrastructure, unless otherwise specified by the participating Facility.
Data Retention
FamilyTalk retains information only as long as necessary to operate the service and meet Facility requirements. Participating Facilities may request deletion of user data.
User Rights and Controls
Because FamilyTalk operates only through participating Facilities users may request access, correction, or deactivation through their Facility. Facilities control all aspects of account management and participation of the App.
Children’s Privacy
FamilyTalk is not intended for unsupervised use by minors. Participating Facilities are solely responsible for supervision, eligibility, and consent.
Advertising and Tracking:
FamilyTalk does not display advertisements, sell personal information, use third-party advertising networks or services, and does not track users across applications or websites.
Changes to Policy:
FamilyTalk may update this Privacy Policy from time to time. Updated versions will be posted within the App and on our website with a revised effective date listed.
